On Tuesday May 4, 2010 Senator Daylin Leach introduced The Pennsylvania Compassionate Use Act. A companion bill in the House that saw committee hearing in December is still active. The Senator stood at a Capitol press conference surrounded by patients, doctors and advocates with the group Pennsylvanians for Medical Marijuana (PA4MMJ). "Medical Marijuana has been proven repeatedly to help people who are desperately ill. It is nothing more than gratuitous cruelty to deny it to them," Senator Leach said at the press conference. Rep. Mark Cohen, who introduced the bill last year in the House spoke as well.

The Seate introduction marks an important milestone for medical cannabis in PA because having the bill active in both houses of the legislature is essential to it being passed.

The bill was assigned number SB 1350 and referred to the Senate Public Health and Welfare Committee. Public hearings before that committee should be scheduled soon.

The medical marijuana program outlined in the PA bill would allow home cultivation and the taxed sale of cannabis through Compassion Centers. A doctor must approve and recommend the use for specific medical conditions and each patient would carry a registry card.

Patients, their families and local advocates are asking for PA residents to contact their state Senators asking them to co-sponsor and support SB 1350. Sandra "Sandie" Stronko-Crue is an MS patient who attended the 5/4 introduction:

"We need this in Pennsylvania."

Looks like 1393 to me. I am glad to see another MMJ bill put forth.
Some things not to like

Just how did they become experts on marijuana security and transportation? They are the ones that have been raiding our homes and putting us into jails for years and now we have to trust them. Is this a cruel joke?
 
I would think the Pennsylvania Department of Agriculture would be more able to deal with marijuana regulations and inspections though:

The Bureau of Plant Industry is already in place and has set up systems that have befitted all Pennsylvania.
The Penn State Cooperative Extensions http://extension.psu.edu/ would be very helpful.

A source in Hanover heard that The Medical Movement's Chuck Homan (at left in photo) was arrested for placing a sign in a public place and his medicine was found in his car.  Is this true?  If so, it's a bail violation on his pending cultivation charge.  Maybe it's time to admit his marijuana addiction, get some appropriate psychiatric therapy and take the hit now rather than later.  He's been a very effective lobbyist but this would hurt his cred.

I've got the nursery/greenhouse license with the Department of Agriculture and also the seed dealer's license.  It would be a very good idea for the Health scretary to coordinate with the Agriculture Department. The plant inspector(s) come out and check for diseases and pests and review records if neccesary. Pesticide use is one that I am concerned about with mj. Personally I've never sprayed with anything more potent than pyrethrins or neem oil for my nursery plants but some people might bring out the big guns for spider mites tho it isn't needed. I'd like to see grow operations that supply compassionate use centers limited to a small number of employees thus ensuring the pharmacy giants stay the hell out and give small, rural operations in the hardest hit economically depressed areas a shot at providing jobs and income. Supposing that mmj gets passed that is.

regarding Chuck Homan-
He's someone who is working very hard so that all of us might have access to MMJ. If you're having some problems with him, you should either let it go or try to work it out between the two of you. Stop posting messages on this and the med. movement website badmouthing the guy.

I agree that Chuck has done a great job with his public rallies and extensive lobbying, having advised him on publicity and political matters.  But my concern is that he has longstanding and untreated psychiatric disorders (including marijuana addiction) which will not be cured with California bud alone.  He faces prison for growing unless he can persuade a judge or jury that he has a medical necessity defense to grow and smoke weed, an uphill battle and unlikely result in York County or any court today.  He is grandiose and delusional (what is his Grand Plan and why is it secret?) and I fear he is capable of losing it and doing something violent or destructive which he will regret for a long time.  His messianic religious zeal ("doing the Lord's will") and scary demeanor are negative aspects of his advocacy which may well cancel out all the good he's done.  I'd like to see him stop conning himself, his family and his supporters about why he smokes like a chimney and get some effective medical care.  He's a good man who is in a load of trouble and I wish him well.

On May 28, Chuck's attorney filed a Notice of Insanity or Mental Infirmity Defense in his pending cultivation charges in York County (see my website for a link).  I suspect this is a result of his planned necessity defense in which he would need medical testimony of his need for Cannabis as medicine for his asserted bipolar disorder.  Hopefully it will lead to competent psychiatric therapy so he can get through this ordeal and get on with his life.  He's a good man who's been way out there for way too long and resistant to any suggestion that he needs more than Kush to get better.  It will most likely not lead to acquittal because insanity defenses seldom succeed, even when people say "he must have been nuts".

CHUCK HOMAN SHUTS DOWN MEDICAL MOVEMENT BLOG, BLAMES JEFF SPANGLER

His message:

Thank you to all those who blogged positive, supportive, and educational posts.  This part of our web site was meant for a support for all those out there suffering or know of someone who is suffering and would benefit from the use of medical marijuana.  It was never intended to have a few spew negativity and use it as a forum for their own egos, so therefore, this part of our web site will be closing.  Jeff Spangler came up to me at the April 20th event at the Harrisburg capital last year and said he was a friend of Chuck’s from grade school and that he wanted to help.  Chuck asked him to look up information for him and then he offered to maintain the web site for us.  He posted information Chuck asked him to, and some HE felt should be posted, but it was all voluntary on his part to help with the “movement”.  We had numerous supporters asking us why Jeff was taking over the web site.  Since we are the one’s who set up the web site, we decided that it was time to thank Jeff for his “help”, and let him know we no longer required it.  He couldn’t stand not being in control of OUR web site, which Chuck started to educate folks and to show all those who would like to do something rather than sit by and watch our government take away our civil rights that there is someone out here that is willing to stick his neck out.  (I know, Jeff, that was probably not a properly formed sentence.  We are just simple, plain spoken people trying to make a difference.)  We invited him in to our home, fed him, and offered him a bed to sleep in, and friendship.  I’m not sure why he cannot just go on with his life, but feels the need to act despicably.  For the short 2 ½ months he “helped”, it sure feels a lot longer and we could have done without it!

With friends like this, who needs enemies!

Jeff, please use your time more wisely in supporting HB 1393 and SB 1350 instead of trying to spite someone who is actually DOING something about it, unless you could really care less about it.  

Chuck would still like to hear from those who are sincere about this movement and you can do so on the “Contact Us” page or by calling him.

When it comes to Jeff Spangler there is a lot that I could say however, I am going to speak the truth about the statements that Jeff has said about me.  In regards to all of his attacks on me personally, the truth is the things that he said about me apply to him.

YOU CAN'T HANDLE THE TRUTH

It's not surprising to see you've opted out of robust discussion of the issues, including your own credibility and sanity, by shutting down your comments page.  Blaming me for trying to "take over" your website is a crock and missates the truth that you declined further help, and when you refused to take down my copyrighted material, I started attacking you for the fraud you are.  My template for letters is still up and should be taken down, as well as my laboriously compiled list of legislators if it's still there.  The information is public but the compilation took a long time and is my work.

You suffer from severe mental disorders and can't take constructive advice on press and political matters where I offered my extensive experience.  You expressed gratitude for my assistance on publicity and lobbying, but now Chris Goldstein gets all the lobbying credit and you say you could have done without my help.  All you want is the "right" to keep scoring your CA bud and illegally shipping it back to PA.  Be careful what you say at trial if you testify because you are not immune from federal prosecution for those trips.

You are a bully and a liar who is headed for jail because you're a marijuana addict who is powerless over your addiction.  You need a shrink and traditional Big Pharma meds more than you can appreciate, and a sentencing judge will impose that help for you.  I'd love to help the DA send you up, and will consider offering my assistance.

To the extent that your comments are defamatory, you should tone them down or risk legal action.  To the extent that my comments are true, they are protected speech which you can't effectively fight with more speech, only your petulant refusal to engage in dialogue.  Good luck with your insanity charade.  I hope to attend.

Well, knowing the typical politician, they are all, either he or she, using/abusing something.  I wonder how many could pass a urinalysis and how many need alcohol rehab, family counseling or have a family member who is involved in this type of behavior.  They are crazier then any normal, run-of-the-mill medical cannabis patient.  joint peace
